Policies


By placing an order with PromoSpark you have agreed to the terms and conditions described in the following policies:

PAYMENT:

  • Each order is customized so we must receive financial obligation before beginning work on any order.
  • ORDERS WILL NOT BE PROCESSED UNTIL PROMOSPARK RECEIVES ONE OF THE BELOW PAYMENT OPTIONS:
    1. SECURE payment with Visa or MasterCard * so order can be processed immediately &then mail check (credit card is NOT charged if payment is received by invoice due date).
    2. CHARGE Visa or MasterCard *.
    3. FAX purchase order to 513-844-2988.
    4. MAIL check to PromoSpark, PO Box 18-1147, Fairfield, OH, 45018. Order is onhold until check arrives.
    * To secure payment or pay with Visa or MasterCard we need:
    1. Visa or MasterCard number
    2. Full name as it appears on the credit card
    3. Expiration date
    4. V-code (last 3 digits on the back of the card)
    5. Complete street address the CARD IS BILLED TO
    6. City and State the card is billed to
    7. Zip code the card is billed to
  • PromoSpark is NOT responsible for any setback in production caused by a delay in receiving one of the above payment options.
  • If paying with a personal check for a group order, please do not send multiple checks. If organization will not issue a check until all funds are collected from individual members, it is the buyer's responsibility to secure all funds before placing an order. A Visa or MasterCard may be used to guarantee payment when a check will be mailed, but PromoSpark reserves the right to charge the credit card if the check is not received within Net Terms. We do not ship C.O.D. A $35 fee applies for all returned checks in addition to the balance due on the order.
  • If organization pays for all or part of the order by purchase order, the remaining balance on the order must be paid by check or money order within Net Terms stated on the invoice. If this payment is not received within the Net Terms, we reserve the right to charge late fees (as stated on invoice) in addition to the balance due.
  • If organization pays through the university's purchasing system, we must be given a contact person's name and telephone number to arrange payment before order can be processed. It is the purchaser's responsibility to make sure PromoSpark receives payment within Net Terms to avoid late fees.
  • After order is placed pricing can not be changed.

LOWEST PRICE GUARANTEE:

  • We have a Lowest Price Guarantee! If you find a lower price, we will BEAT that price by 2%. Simply send us a copy of the quote or website link showing the lower price.
  • Must be for the same item, item color, quantity, decoration & production time.
  • Shipping & set-up charges must be clearly stated.
  • Only valid on 48+ qty.
  • Only valid prior to artwork approval, final sizes, shipping address & payment information given.
  • PromoSpark reserves the right to decline going lower on any jobs that are not within our business model.

TAX EXEMPTION:

  • Ohio organizations will be charged sales tax unless PromoSpark receives organization's exemption number before payment is made. Organizations must follow state guidelines to be tax exempt. For your convenience, once we have organization's tax exempt number, it will be kept on file for future orders. Orders are only tax exempt if check is from university, organization, school or business account. No personal checks accepted for tax exemption orders.

ARTWORK:

  • If you are emailing us artwork, please send in one of the following formats:
    • Vector/line art preferred: Adobe Illustrator 10 (or lower), Corel Draw 11 (or lower), .EPS or .WMF
    • Camera ready artwork: black and white image with a minimum of 300 dpi in .JPEG, .TIFF, or .PSD
    • Multi-color artwork: email design with a minimum of 300 dpi in .JPEG, .TIFF, or .PSD - If sending .JPEG, .TIFF, or .PSD files please provide font support.
    • If sending files over 3MB, compress using Winzip or Stuff It.
  • Pricing can easily be given without creating custom artwork.
  • We do provide our customers with FREE custom artwork. However, if you (or your organization) cancel the order for any reason AFTER an art proof is created, you will be charged a $50 cancelation fee.
    For your convenience, if you do proceed with this artwork on ANY future order you will be CREDITED $50 on that order.
  • Artwork proofs are emailed within 1 business day for your approval. Phone notification is made once artwork proof has been emailed. If there is anything you do not like about the artwork proof, please let us know & an updated proof will be emailed to you ASAP. YOU ALWAYS APPROVE ARTWORK BEFORE WE PRINT!
  • Select a design from our design gallery, use your own artwork idea or email us a link of an example. Any design provided or chosen can be modified (change colors, text, make distressed look, etc.). We provide this service ABSOLUTELY FREE.
  • If the deadline PromoSpark gives you is a problem, please let us know immediately & we WILL work with you. Rush charges only apply if necessary.
  • Please double-check all information on the Artwork Proof: imprint color, imprint size, imprint location, SPELLING & that all aspects of design are included.
  • PromoSpark is NOT responsible for any errors discovered after the product is printed if the errors were contained in the final approved Artwork Proof.
  • Each order is printed based on customer's final artwork approval. Please approve Artwork Proof sheet very carefully to avoid any problems.
  • The artwork proof is our closest representation to give you a general idea of the product you will receive. The item, item color, ink color and artwork size are NOT exact or to scale. Refer to the design details on the artwork proof for exact information.
  • If design contains an actual photograph, final print result will vary (similar to newspaper print).
  • PromoSpark is not liable for any variances between the colors and graphics displayed on your monitor and the completed product you receive.
  • PromoSpark is NOT responsible for any setback in delivery or shipping caused by a delay in artwork approval.
  • We reserve the right to display any artwork on our website or promotional material for the purposes of advertising. We reserve the right to refuse to create or print artwork that is unlawful or inappropriate. All artwork becomes property of PromoSpark.

STANDARD PRODUCTION TIME:

  • SCREEN PRINTING & EMBROIDERY: Standard production time is 5-9 working days + transit time once we have your artwork approval, final sizes/qty, shipping address & payment information.

SHIPPING:

  • FREE ground shipping on all apparel orders.
  • Contact us for shipping charges on promotional products as it varies for each item.

  • We cannot ship to post office boxes. We must have actual street addresses, not just hall or building names.
  • PromoSpark is not responsible for shipping errors made by the carrier or from any factor beyond PromoSparks' control.

ADD-ONS:

  • No changes (quantities, sizes, artwork, item, etc.) can be made once artwork has been approved or order has been processed. Re-orders can be placed as long as the minimum order requirements are met. To avoid problems, please ensure that members of your organization are aware of this policy. Therefore, you may want to order a few additional items.
  • Add-ons are not always possible and additional charges may apply.

RE-ORDERS:

  • Re-order pricing is based on the re-order quantity, not the initial order quantity.
  • Re-orders are not always possible.
  • SCREEN PRINTING & EMBROIDERY: 12 items minimum of the same style and same design of initial order. The 12 item minimum also requires the EXACT same artwork (if initial order consisted of various artworks). No set-up charge on exact re-orders.
  • PROMOTIONAL PRODUCTS: Contact us, as it varies for each item. Re-order set-up charge varies.

RETURNS / EXCHANGES:

  • All orders are custom-made. Therefore, no returns can be made unless the items ordered are defective. PromoSpark cannot guarantee reproduction of defective products. A refund will be given in most cases.
  • Items with any type of printing or embroidery may form stress marks or tears over time. Washed or worn garments with this type of damage cannot be replaced or returned for a refund.
  • PromoSpark is not responsible for garments or any item that does not fit. Samples can be ordered for any item to make sure this is not an issue.
  • PromoSpark is not responsible for any problems with orders that have been opened or left unattended after they are delivered.
  • If a problem does arise with your order, please contact PromoSpark within 72 hours of receiving your order. Do not return items without first calling us. Items cannot be returned more than two weeks after receipt for any reason.

ORDER CANCELLATION:

  • All orders are custom-made based on the customer's instructions at time of ordering. Therefore, the customer is responsible for any costs incurred by PromoSpark up to the point of cancellation. There is a minimum cancellation fee of $45.00.
  • Items are ordered the same day sizes and/or quantity are given. Therefore, if the order is cancelled, a 15% restocking fee of the original invoice and necessary shipping fees will be charged (regardless of whether final artwork has been approved).
  • If you must change the color of the items ordered and the item has been ordered, a 15% restocking fee of the original invoice and necessary shipping fees will also apply.
  • If your order has already been produced it CANNOT be cancelled...NO EXCEPTIONS. It is the customer's responsibility to ensure they have ordered correctly.

PERSONALIZED NAMES / ROSTERS:

  • A typed name list must be submitted via email in Microsoft Word or Excel for all orders requiring individual names (athletic jerseys, rosters, etc.).

SIZES GREATER THAN XL:

  • Sizes greater than XL will incur an additional charge & it may vary per item.

SET- UP CHARGES:

  • SCREEN PRINTING: Absolutely FREE if 144+ qty! $25.00 total set-up charge for 12-143 qty. Contact us for set-up charge on 4-color processing.
  • EMBROIDERY: Absolutely FREE if 144+ qty! Letters and/or straight line text: $25.00 total. Logo or specific graphic design: $10.00 per 1,000 stitches.
  • PROMOTIONAL PRODUCTS: Contact us, as it varies for each item.
  • No set-up charge on exact apparel re-orders. Set-up charge for promotional product re-orders can vary.

BACK-ORDERED / DISCONTINUED ITEMS:

  • PromoSpark reserves the right to substitute items of comparable value and style in the event that the particular item ordered is temporarily out of stock or discontinued. If time allows, we will notify you of any substitutions. PromoSpark has no control of items that are on back-order or discontinued.

GARMENT CARE:

  • Machine wash all apparel in cold water and lay flat to dry. Do not add bleach or other chemicals. Wash all apparel separately. We are not responsible for apparel that may shrink. PromoSpark is not responsible if you do wish to put garments in dryer and ink melts or wears in any way.

  • PromoSpark will NOT for any reason use your information (name, address, email, etc.) for any other purpose than to process your order, continue future business, introduce new products or information and inform you of specials.

LICENSED, PATENTED OR TRADEMARKED DESIGNS:

  • The customer represents that all materials, which the seller uses to create and produce items described by PromoSpark and shown on website or promotional material (including, but not limited to insignias, special designs, logos, crests, coat of arms, sorority letters, fraternity letters, school, university references or custom designs), will not cause or result in the violation of any law, judicial decision, rule, regulation, ordinance, licensing, franchise or similar arrangements, formal or informal, written or oral relating to patents, copyrights, trademarks, service marks, etc.
  • The customer further represents that by commissioning and hereby requesting the seller to perform physical or intellectual labor, the customer has full authority to purchase and grant the seller rights to produce, create, and sell any design or product created.
  • The customer recognizes that the seller will assume no liability for any laws, rules, agreements, etc. in compliance with the customer's commissioning of work. PromoSpark disclaims all liability, if any.
  • The customer agrees to indemnify and hold the seller harmless from and against any licensing fees, damages, fines, penalties, losses or assessments including attorney's fees which may be incurred by the seller as a result of the seller processing any order commissioned by the customer. The depiction of any logo, name or design on our website or promotional material is for demonstrative purposes only and does not imply that any such design, logos, or names can be reproductive without proper authorization or permission.

OTHER:

  • Screen print pricing is based on the same artwork for all items printed in the same location (unless otherwise noted).
  • PromoSpark is not responsible for typographical errors on our website or promotional material.
  • PromoSpark reserves the right to change these policies or prices at any time without notice.
  • PromoSpark owns all artwork produced and artwork cannot be reproduced or printed by any other company without PromoSpark written consent.
  • 1 FREE item is given to the purchaser on every order of 48+ items with the same design. If more than 1 item is used with the same design to total the 48+ items the least expensive item is the one you will receive FREE.
